PhotoShark helps you back up photos and videos from your phone to storage you control, such as your computer or an external drive. The Website provides account access, product information, support, and related online features. PhotoShark software may be distributed separately for installation on your devices.

5) Pricing and payments

  • Current offering: PhotoShark is free with no subscriptions, credits, or lock-in.
  • Renewals: Not applicable — there are no paid subscriptions.
  • Refunds: Refund Policy — PhotoShark is currently free; paid offerings, if introduced later, will be covered by our refund policy.

You are responsible for any hardware, storage media, or third-party services you choose to use with PhotoShark.

6) Your content and backups

You retain your rights in photos, videos, and other content you back up ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely when needed to operate and provide the Service (for example, if you upload files to our servers for support) and to maintain security and compliance.

You represent that you have all necessary rights to back up and use Your Content and that it does not violate law or third-party rights.

7) Acceptable use

  • Do not use the Service for illegal activities or to violate third-party rights.
  • Do not back up or distribute content you do not have rights or permission to use.
  • Do not bypass security controls, rate limits, or access restrictions.
  • Do not interfere with or disrupt the Service or its infrastructure.

Your rights to use PhotoShark software and backups you create are governed by the License: https://photoshark.io/license. If there is a conflict, the License controls for software use.

12) Disclaimers

13) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, including loss of photos, videos, or data. Our total liability is limited to the amount you paid us in the 12 months before the claim, except where liability cannot be limited by law.

14) Indemnity

You agree to indemnify and hold harmless Vista Studios Ltd from claims arising from your use of the Service or Your Content.
