This License governs your use of PhotoShark software and backups made available through PhotoShark operated by Vista Studios Ltd.

1) Definitions

• "Software" means the PhotoShark application and related components we make available for download or installation.
• "Backups" means photos, videos, thumbnails, indexes, and metadata created or stored through your use of the Software on devices and drives you control.
• "Your Content" means photos, videos, and other materials you back up or process with the Software.

2) Ownership

We (or our licensors) own the Software and the Service. You retain ownership of Your Content and your Backups.

3) License grant (Software)

Subject to your compliance with the Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software as follows: Personal, non-commercial use of the PhotoShark software.

Subject to your compliance with the Terms, you may use Backups you create as follows: Personal, non-commercial use of backups and indexes created with PhotoShark.

5) Restrictions

• No selling, sublicensing, or redistributing the Software except as expressly permitted in writing.
• No reverse engineering or decompiling the Software except where permitted by applicable law.
• No sharing accounts or circumventing access controls on the Website.
• No use that violates laws or third-party rights (including privacy and publicity rights).

6) Termination

This License terminates automatically if you violate the Terms or this License. Upon termination, you must stop using the Software. Your Content and Backups on your own storage remain yours.

7) Disclaimer

The Software is provided "as is" without warranties to the maximum extent permitted by law. You are responsible for verifying backups and maintaining copies of important data.
